These Terms and Conditions (“Terms”) govern the use of Callpay Payment Processing Services (“Services”) provided by Callpay (“we”, “us”, or “our”). By using our Services, you (“User”, “you”) agree to be bound by these Terms. Please read them carefully.
2. Using and Saving of Login Credentials for Internet Banking
2.1. Consent to use and process Credentials: By using Callpay Services to make a payment, you irrevocably authorise us to use your internet banking login credentials (“Credentials”) and other personal information, such as your full names and surname, identity number and or mobile number, as required in order to facilitate and process such payment. You agree that we may use such Credentials and information to process the payment as if we are instructing the payment ourselves and for such purpose to liaise and communicate with your bank on such basis, including to facilitate the payment authentication processes implemented by your bank, without negating the security thereof. For purposes of the aforesaid, you specifically consent to us processing your personal information in terms of sections 11(1)(a) and (b) of the Protection of Personal Information Act, No. 4 of 2013.
2.2. Consent to Store Credentials: By using Callpay Services to save your internet banking login credentials (“Credentials”), you authorize us to store these Credentials securely for the purpose of facilitating faster login and transaction processes.
2.3. Security Measures: We employ robust security measures to protect your Credentials from unauthorized access. However, you are responsible for ensuring the security of your device and internet connection.
2.4. Use of Credentials: Your Credentials will only be used to process transactions you have authorized and for no other purpose. You must ensure that your Credentials are accurate and up to date.
2.5. Liability: We shall not be liable for any unauthorized use of your Credentials unless such use is directly attributable to our negligence or wilful misconduct.
3. Making an Instant Payment via Internet Banking
3.1. Instant Payment Service: We offer an instant payment service allowing you to make payments via internet banking, which are processed more quickly than standard transactions.
3.2. Fees: Instant payments incur higher fees than standard transactions. By opting for an instant payment, you agree to pay the applicable fees as disclosed at the time of the transaction.
3.3. Authorization and Processing: By initiating an instant payment, you authorize us to debit your designated bank account for the payment amount plus applicable fees. We will make every effort to process instant payments promptly, but we do not guarantee a specific transaction time.
3.4. Refunds and Disputes: If you have an issue with an instant payment, please contact our customer service. Refunds and dispute resolutions are subject to our refund and dispute policies, which are available on our website.
4. General Provisions
4.1. Amendments: We reserve the right to amend these Terms at any time. Your continued use of the Services after any amendment signifies your agreement to the revised Terms.

5. Acceptance
By using the Callpay Payment Processing Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
Any dispute arising from or in connection with this Agreement shall be referred to and finally resolved by arbitration in accordance with the Rules of the Arbitration Foundation of Southern Africa (AFSA). The arbitration shall be conducted by an arbitrator or arbitrators appointed by AFSA. The decision of the arbitrator shall be final and binding on the parties, and not subject to appeal. The arbitration proceedings shall be conducted in Cape Town and the language of the arbitration shall be english.
